Protecting the individual freedoms of all Americans are ideas taken directly from the Magna Carta. Many of the ideas and rights recognized by Magna Carta are also recognized by the U.S. Constitution. Clause 1 of the Magna Carta grants that the church shall be free. This has been interpreted historically by some to be a protection of the church from state power, similar in some ways to the protected granted by the First Amendment of the U.S. Constitution. Clause 29 guarantees the right to due process of law, in very similar fashion to the Fifth Amendment. One of the most important rights recognized by Magna Carta and also recognized by the United States judicial system is that right of habeas corpus. Clauses 36, 38, 39, and 40 collectively define this right in Magna Carta, while it is guaranteed in Article I of the U.S. Constitution.
