    |dw:1436712715209:dw| i can't draw to save my life so here is a start in 2D. \(\phi\) is the azimuth [and \(\theta\) the polar] from the dV element you have posted - always worth checking integrating using that dV element will give you the volume you'd get by revolution of the shaded area in the drawing - that's how spherical works. so you will need to add in extra for the cone that is missed out.
